A. Player Responsibilities
1. Participation Commitment
By registering for and participating in the Manhattan Tennis Association (the “League”), each player (“Participant”) agrees to complete all scheduled or assigned matches in a timely and good-faith manner. Failure to respond to communications, persistently canceling, failing to schedule, or failing to appear for matches may result in suspension or removal from the League without refund. Repeated non-responsiveness may result in permanent ineligibility for future League participation.
2. Conduct and Sportsmanship
Participants shall conduct themselves in a manner consistent with principles of good sportsmanship, respect, and integrity. Harassment, abusive language, threats, cheating, or any other behavior deemed unsportsmanlike or disruptive by 10S212NY LLC may result in immediate suspension or permanent removal from the League without refund. 10S212NY LLC retains full discretion to determine whether conduct is unacceptable.
3. Communication Requirements
Participants must maintain an active and accessible email address and are responsible for reviewing and responding to official League communications, including scheduling notices, rules updates, and score reporting requests. Participants who unsubscribe from League emails or otherwise fail to receive required communications may be removed from the League without refund.
B. Waiver and Assumption of Risk
1. Acknowledgment of Risks
Participation in tennis inherently involves physical risks, including but not limited to strains, sprains, falls, collisions, exposure to varying weather conditions, property damage, and in rare circumstances, serious injury or death. By registering for the League, Participants knowingly and voluntarily assume all such risks, whether foreseeable or unforeseeable.
2. Insurance Responsibility
10S212NY LLC does not provide medical, health, or personal property insurance for Participants. Each Participant is solely responsible for maintaining their own insurance coverage or accepting full financial responsibility for any injury, damages, or medical expenses incurred during League play or related activities.
3. Facility Conditions
Matches may occur on public, private, or independently managed tennis courts across New York City. Participants are solely responsible for inspecting all playing surfaces, equipment, and surrounding areas prior to play and for determining whether conditions are safe. By electing to play, Participants assume all risks associated with the facility or environment.
C. Release of Liability, Covenant Not to Sue, and Indemnification
1. Release of Liability
In consideration of being permitted to participate in the League, Participants, on behalf of themselves, their executors, administrators, heirs, successors, and assigns, hereby release and forever discharge 10S212NY LLC, the Manhattan Tennis Association, its owners, officers, agents, contractors, volunteers, and affiliates (“Released Parties”) from any and all claims, demands, actions, liabilities, or damages arising out of or in any way connected with participation in the League or use of League-related facilities—including claims arising from the negligence of the Released Parties.
2. Covenant Not to Sue
Participants agree that they shall not initiate or maintain any lawsuit, claim, or action against the Released Parties for any injury, loss, or damage connected to League participation. This covenant is intended to be broad and inclusive under applicable law.
3. Indemnification
Participants agree to indemnify, defend, and hold harmless 10S212NY LLC and all Released Parties from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising from their participation in the League, violation of these Terms, or misuse of League resources or facilities.
Website Terms of Use
1. Acceptance of Terms
By accessing the Manhattan Tennis Association website, registering for League participation on Global Tennis Network, or using any services provided by 10S212NY LLC, the user agrees to these Terms of Use and all applicable policies. 10S212NY LLC may modify these terms at any time without prior notice, and continued use constitutes acceptance of the updated terms.
2. Description of Services
The website provides tools and resources including but not limited to match scheduling, player communication, rankings, event information, and score reporting. All services are provided solely for personal, non-commercial use in connection with League participation.
3. Account Security and Responsibility
Users are responsible for safeguarding their login credentials and for all activity conducted under their accounts. Any unauthorized access or suspected breach must be reported to 10S212NY LLC immediately.
4. Prohibited Conduct
Users may not:
Engage in any unlawful activity through the website or League resources;
Misuse, harvest, or commercially exploit player information;
Attempt to disrupt or compromise website functionality;
Impersonate other players, falsify results, or interfere with League operations.
Violation of these prohibitions may result in immediate suspension, account termination, or permanent removal from the League.
5. Photos, Media & Public Use
By participating in League activities or submitting photographs, videos, or other media, Participants grant 10S212NY LLC a non-exclusive, royalty-free, perpetual license to use such media for promotional, informational, or community purposes across digital and print platforms without compensation.
6. Disclaimer of Warranties
The website and all associated services are provided “as is” and “as available.” 10S212NY LLC makes no warranties or representations regarding uninterrupted operation, accuracy, or reliability of the website or services.
7. Limitation of Liability
10S212NY LLC and the Released Parties shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the website, participation in the League, or reliance on any League-related information.
